Article 1: Transport Document (Service Contract)

  1. Completion of the shipment request or use of Zajil's services constitutes an explicit acknowledgment by the sender that they have read, understood, and accepted all terms and conditions contained in this contract, which shall be binding upon both parties.

  2. The sender affirms that the shipments are fully owned by them or that they are duly authorized to transport them, and accepts full responsibility for any damage, cost, or additional expenses incurred by Zajil as a result of their violation of these terms.

  3. The sender must accurately complete all shipment details in the airway bill and transport document, including addresses, number of parcels, nature of contents, and their declared value.

  4. Completion of the shipment request without reservation constitutes the sender's acknowledgment of the accuracy of all declared information.

  5. This contract, together with its annexes (including the Compensation Policy for Beneficiaries), shall constitute a single, integrated agreement defining the rights and obligations of both parties.

  6. The service provider shall issue this contract in both Arabic and English, detailing the service type, fee, insurance value (if applicable), sender and recipient information, and the compensation mechanism.

  7. The beneficiary is entitled to receive a printed or electronic copy of the contract, and the service provider must retain it for no less than one (1) calendar year. In case the contract is lost, Zajil's customer service shall provide the beneficiary with a replacement copy.

  8. The service provider shall make available multiple payment options (cash or electronic) and provide the beneficiary with an invoice, which shall be retained for one (1) year.

Article 2: Prohibited Shipments

The following items are strictly prohibited:

  • Narcotics and alcoholic substances.
  • Local or foreign currency, gold, silver, or precious metals.
  • Explosives and weapons.
  • Printed materials or items that violate public order, morals, or laws.
  • Works of art, gemstones, commercial papers, perishable goods, animals, or any items prohibited by the Transport General Authority.

The following items may only be transported under a special contract, with prior insurance, or at the beneficiary's own risk:

  • Antiques, jewelry, watches, and prepaid cards.
  • Electronic and smart devices.
  • Fragile items or items exceeding a value of SAR 500.
  • Medical materials.

Article 3: Right to Refuse Shipment

  1. Zajil reserves the full right to refuse shipment of any item at its sole discretion or for regulatory reasons.

  2. Zajil may also refuse any shipment after acceptance if it is found to be prohibited or poses a risk to other shipments, while notifying the sender accordingly.

Article 4: Inspection of Shipments

  1. Zajil has the right to open and inspect shipments when there is suspicion, to ensure that they are eligible for transport.

  2. Zajil may also open shipments upon the request of competent authorities, and the records of such inspections shall be deemed valid and binding evidence.

Article 5: Delivery, Retrieval, and Address Correction

  1. The shipment shall be delivered to the recipient at the agreed time and place, within ten (10) days of the date of shipment, considering any exceptional circumstances.

  2. The service provider may extend the delivery time if a correction or modification to the delivery address is requested.

  3. Zajil shall not be liable for any delay or misdelivery caused by an incorrect address or the recipient's refusal to accept delivery.

  4. Delivery to the recipient shall be deemed conclusive proof of proper delivery unless a written complaint is submitted within thirty (30) days of receipt.

  5. After the shipment is ready for collection, the service provider shall attempt to contact the beneficiary three (3) times within fourteen (14) days via the registered contact methods (phone, SMS). If the beneficiary fails to respond within this period, the shipment shall be considered unclaimed, and the official storage period shall begin in preparation for disposal or destruction as per applicable regulations.

  6. After the ninety (90) day storage period ends, Zajil may sell or destroy local shipments, or sell non-domestic shipments. Perishable goods may be destroyed before this period if necessary.

Article 6: Privacy

Zajil undertakes to:

  • Protect the confidentiality of customer information and prevent unauthorized access.
  • Disclose information only when required by law, with the customer's consent, or upon request from competent authorities.
  • Record and monitor access to data and define the purposes for which it is collected and retained.

Article 7: Obligations and Responsibilities

  1. The sender bears full responsibility for the accuracy of all information provided and for any damages or additional costs resulting from errors.

  2. The sender or recipient, as applicable, shall bear the cost of return, redirection, or storage fees.

  3. The service provider shall retain the shipment for ninety (90) days after the delivery deadline before taking further action.

  4. Customer complaints shall be processed within seven (7) business days after receipt of all required documents, and a reference number shall be provided to the complainant.

  5. No claim shall be considered if the required documentation is not completed within thirty (30) days from the date of request.

Article 8: Compensation and Claims

  1. The service provider shall compensate the beneficiary (sender or recipient) in cases of delay, misdelivery, loss, damage, or shortage.

  2. For insured shipments, compensation shall not exceed the declared value stated in the service contract.

  3. For uninsured shipments, compensation shall not exceed SAR 100 or the shipping fee, whichever is higher.

  4. In cases of delay exceeding fourteen (14) days or incorrect delivery due to Zajil's negligence, compensation shall be limited to the shipping fee only.

  5. Only one type of compensation may be claimed for each shipment.

  6. The service provider shall not be liable for indirect or consequential damages or loss of profit.

  7. The recipient shall be compensated instead of the sender in cases where the recipient bears the shipping fee.

  8. Compensation shall not apply in cases of force majeure, customer negligence, or prohibited items.

Article 9: Limitation of Liability

  1. Zajil's liability limits shall be determined in accordance with Articles (3) and (4) of the Compensation Policy for Beneficiaries.

  2. Zajil shall not be held liable for indirect damages, consequential losses, or any duties or taxes.

  3. Compensation shall be calculated based on the value of the shipment at the time of service.

Article 10: General Provisions

  1. These terms and conditions apply to all shipments handled by Zajil.

  2. If a separate contract exists, these terms shall remain valid insofar as they do not conflict with it.

  3. The Compensation Policy for Beneficiaries shall prevail in determining compensation mechanisms in the event of any inconsistency.

  4. These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia and the Transport General Authority.

  5. This contract shall come into force upon its official approval.
